Hon’ble Mr. R N Singh, Member (J):
1. In the present OA, the applicant is aggrieved by memorandum dated 30.01.2025 vide which a departmental proceeding under Rule 14 of CCS (CCA) Rules, 1965 has been initiated against him.
2. On bare perusal of the impugned memorandum, it is apparent that the same has been issued from the office of the respondents situated at Mumbai and the same is close to the applicant’s office through the Chairman, AERB having office at Mumbai and the applicant is admittedly residing in Austria. The applicant has signed and verified the present OA at Vienna, Austria. Prime-facia this Bench of the Tribunal is not having territorial jurisdiction in the matter.
4. At this stage, learned senior counsel appearing for the applicant under instructions seeks permission to withdraw the present OA with liberty to the applicant to approach the appropriate Bench of this Tribunal in the matter.
6. Permission is granted. OA stands dismissed as withdrawn with liberty as aforesaid.
