1. This O.A has been filed under Section 19 of the Administrative Tribunals Act , 1985 seeking the following reliefs:
“(i) Quash the inaction of respondents in not considering and promoting the applicant to the post of Professor (Stage V) w.e.f. 18.11.2012 when she became eligible for grant of same as provided under UGC Regulations 2010 dated 30.06.2010 duly adopted by Panjab University and applicable to applicant (Annexure A2), for which promotion she became eligible pursuant to her CAS promotion as Associate Professor vide dated 19.06.2024 w.e.f. 18.11.2009 (Annexure A4) pursuant to direction by this Tribunal in OA No.18 of 2023 vide order dated 15.12.2023 (Annexure A3), as the non grant of same is harsh, unjust, and amounts to hampering her career progress, disbursal of lower pay and therefore violative of Article 14 and 16 of the Constitution of India.
(ii) Direct the respondents to finalise the claim of applicant for promotion as Professor (Stage V) w.e.f. 18.11.2012 when she became eligible under UGC Regulations 2010 dated 30.06.2010 duly adopted by Panjab University and applicable to applicant (Annexure A2) as raised in representations dated 18.10.2024 (Annexure A5) and dated 03.02.2025 forwarded vide letter dated 05.02.2025 (Annexure A7) and 29.04.2025, for which promotion she became eligible pursuant to her CAS promotion as Associate Professor vide dated 19.06.2024 w.e.f. 18.11.2009 (Annexure A4) pursuant to direction by this Tribunal in OA 18 of 2023 vid order dated 15.12.2023 (Annexure A3), and grant her promotion as Professor from due date with all consequential benefits within a time bound manner.”
2. The brief facts of the case as submitted by the applicant are as follows:
1. The applicant was appointed as a Lecturer in English at Government College, Karauli on 18.11.1996 and was she was promoted to Lecturer, Sr. Scale on 18.11.2001. The applicant was thereafter selected through Union Public Service Commission on 28.02.2002 and joined as Lecturer at Government Girls College, Sector 11, Chandigarh on 24.02.2003. The applicant was promoted to the post of Associate Professor, Stage-IV w.e.f. 18.11.2009. Pursuant to grant of promotion as Associate from retrospective date the applicant has become due for further promotion as Professor (Stage-V) w.e.f 18.11.2012 under UGC Norms applicable to her college.
2. Vide order dated 18.03.2021, the respondents accorded sanction for counting the past service of the applicant for the period from 18.11.1996 to 23.02.2003 as College Cadre Lecturer rendered by her at Govt. Commerce College, Rajasthan for the purpose of grant of Senior Scale/Selection grade.
3. The respondents vide order dated 19.06.2024 (Annexure A-4), promoted the applicant as Associate Professor w.e.f. 18.11.2009 under UGC, Career Advancement Scheme in pay scale of Rs.37400-
67000+9000/- GP.
4. The applicant has submitted representation dated 18.10.2024 through proper channel to seek CAS promotion under UGC guidelines 2010. It was also indicated that applicant vide representation dated 28.11.2023 had requested the authorities to process her further promotion as Professor while enclosing PBAS application form also. The applicant vide the said representation requested to set up a Committee to look into her case at the earliest and not to club it with other cases where the incumbents became eligible on a later date where subsequent UGC Norms would be applicable. It was also emphasized that her case has been delayed by 12 years, which has caused serious academic setback and huge monetary loss.
