“i) impugned appellate order dated 20.9.2019, punishment order dated 4.2.2019 as well as inquiry report dated 20.8.2018 may kindly be quashed and set aside and exonerate the applicant from all the charges leveled against him.

iii) The respondents may kindly be directed not to reduce of pay to lower (pay cell) by one increment for one year of the applicant and if the respondents reduced the pay to lower by one increment for one year, same will be given to the applicant with all consequential benefits.

iii) Any other directions and orders, which are, deem proper in the facts and circumstances of the case may kindly be allowed to the applicant.”

2. Brief facts of the case, as stated by the applicant, are that on 21.02.2017, Shri Radheyshyam Teli, Gram Sewak cum Secretary, Gram Panchayat Jalodiya Kelukheda Panchayat Samiti Chhoti Sadari made a complaint to the ACB Pratapgarh wherein it had been alleged that from 2006 to 2009, he was working on the post of Gram Sewak cum Secretary in Gram Panchayat Swaroopganj, Panchayat Samiti Chhoti Sadari and during this period, audit was conducted by the Audit Team of A.G. Office in Panchayat Samiti Chhoti Sadari and, therefore, Shri Ramkaran Meena, Assistant Accounts Officer-II, Panchayat Samiti Chhoti Sadari called the record of Gram Panchayat Swaroopganj for getting the same audited by the audit party. In case, he did not want such objections to be raised, he shall have to pay Rs. 9000/- to the audit persons at the rate of Rs. 3000/- per year. If he does not pay, the audit persons shall raise such objections.

3. The applicant further stated that on the basis of the said complaint, the ACB initiated trap proceeding and as per the report of trap team, 3 persons were sitting in the room. Shri Teli told the trap team that the person sitting between the two was Shri Ramkaran Meena, who had demanded and accepted Rs. 7000/- from him in the room where he sits a little earlier in lieu of raising no audit objection by the audit team. Shri Teli also added that after taking money Shri Ram Karan Meena and complainant had come to that room where the two Auditors were sitting; when Shri Ram Karan Meena told them that an amount of Rs. 7000/- pertaining to the period of complainant Shri Teli was received, both the Auditors stated that it was OK and no audit objection will be raised against him.
