The applicant being aggrieved of the order dated 29.7.2022 by which his claim for medical reimbursement regarding his kidney transplantation has been rejected, has filed the present application seeking the following relief –
“That the Hon'ble Tribunal may in the facts and circumstances of the case may be pleased to show the indulgence in the matter and the Hon'ble Tribunal may kindly be pleased to direct the payment of medical reimbursement to the petitioner/applicant while taking into consideration law laid down by the Hon'ble Division Bench of Hon'ble High Court of Jammu and Kashmir and Ladakh at Srinagar in the case titled Jammu & Kashmir V/S Dr. Sakhi Bilai and in Mohd. Azam V/s State of J&K & Ors.”
2. The fact of the case is that –
a) The applicant had complication with his Kidney and that continuous treatment enabled him to lead normal life. It is submitted that Essentiality Certificate in Form No. 2 also came to be issued indicating broadly the nature of the disease of the applican
