Through this OA , the applicant has sought for the following reliefs:

iii. Consequently direct the respondents to reconsider the applicant’s case, in accordance with BSNL corporation office establishment cell, Janpath New Delhi letter No.273-18/2013 Estt- IV dated 21.04.2016 Annexure A12 or in accordance with BSNL Corporate office Esst IV Section, New Delhi letter No.273-

18/2013/CGA/E-IV dated: 15.12.2014, Annexure A10.

iv. Grant any other relief as deemed fit into the facts and circumstances of the case, in the interest of justice and equity.”

2. The facts in a nutshell are as follows :.

1. The applicant submitted a representation for compassionate appointment on 20.01.2010, on the death of her husband, a Telecom employee on 04.04.2009. Upon the rejection of her representation as she secured just 66 points, which was below the cutoff, the applicant challenged the same before this Hon’ble CAT, Bangalore in OA 76/2015, which was dismissed vide Order dated 04.03.2016. The applicant went in appeal to the Hon’ble High Court of Karnataka S SARALADEVI in Writ Petition number 57962 /2016, who upheld her contention in its order dated 25.02.2021 and remanded the matter to the Respondents for reconsideration. The Respondents again rejected her representation on reconsideration vide order dated 03.06.2021. The applicant challenged the same again before Hon’ble CAT, Bangalore in OA No.81/2022. The Hon’ble CAT, vide order dated 21.08.2023, restored the matter to the Respondent No.3 for reconsideration of the matter in the light of the earlier orders of the Hon’ble High Court of Karnataka. However, despite detailed representation submitted by the applicant dated 18.12.2023, the Respondents again rejected her representation vide letters dated 19.01.2024 and 26.02.2024. According to the applicant, she should have got 83 points as per her eligibility in terms of the Weightage System, as per the DoPT guidelines, whereas she was given only 66 points, resulting in her rejection. She says that this rejection is arbitrary, illegal and in violation of the extant orders. Hence, this OA.

The learned Counsel for the applicant has narrated the entire chronological sequence of events, right from the death of her husband, a Telecom employee, her representations for Compassionate Appointment, the orders passed by the Respondents there upon, the orders passed by this Hon’ble Tribunal, the orders of the Hon’ble High Court of Karnataka, the revised representations of the applicant to the respondents, details of the orders/circulars issued by the respondents regarding Compassionate Ground Appointment etc. This is indicated as follows:
