CENTRAL ADMINISTRATIVE TRIBUNAL
Pankaj Kumar, Member-Administrative
Arun Kumar Saxena – Appellant
Versus
Union of India – Respondent
Original Application No. 332/00257 of 2023

Advocates:
For the Appellants/Petitioners: Shri Dharmendra Awasthi
For the Respondents: Smt. Prayagmati Gupta

The court established that pensioners are entitled to the old subscription rates if they apply for a CGHS card before a specified deadline, regardless of subsequent rate changes.

Headnote:The judgment concerns an application for medical reimbursement under the Central Government Health Scheme. The applicant sought to quash the order of rejection pertaining to late application for a CGHS card and demanded a refund of an excess fee paid. The court found the revised rate applicable only post 01.02.2017 was improperly levied due to the issuance date of the card, reaffirming pensioners' rights under OM clarifications.

Result: The application is allowed with directions to refund excess amounts paid.
