1. The present Original Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking the following relief:-

(i) The impugned orders dated 12.04.2022 (A-1) and 31.05.2021 (A-2) issued by O/o respondent No.2 & 3 be quashed/set-aside.

ii) That direction in the nature of mandamus be issued to the respondents to re-consider the case of the applicant in view of the DOPT OM dated 26.07.2012 (A-21) and 30.05.2013 (A-22) and consequently, to consider his candidature for appointment on compassionate grounds in the future Board of Officers meetings to be held by the department without any time limit and if found fit in the subsequent meetings, respondents to be directed to orders of necessary issue compassionate appointment in favour of the applicant with all consequential benefits in the interest of justice.

2. The facts of the case, in brief, are that the Father of the applicant namely Sh. Chaman Lal, who was working as Leading Head Fireman in respondent department, unfortunately, expired on 13.08.2007 (Annexure A-3) while fighting fire on 11.08.2007 at 21 Field Ammunition Depot. The Widow of Late Sh. Chaman Lal submitted request for compassionate appointment in favour of her son Sh. Gaurav Jaswal vide her application dated 16.09.2007 (Annexure A- 5). However, she was advised for self-employment & accordingly she Digitally MAMTA submitted application for compassionate appointment in her favour.

After attaining the age of majority by the applicant, her mother, vide her application dated 11.01.2013(Annexure A-5/A) requested in the department for consideration of the case of her son on compassionate grounds in her place. The mother of the applicant Smt. Rama Devi submitted request applications dated 21.11.2014 and 03.09.2015 (Annexure A-7) to respondent No.2 requesting therein that since her son Sh. Gaurav Jaswal has attained the age of majority, she may be confirmed whether her son can be given compassionate appointment in her place or whether she needs to initiate case for compassionate appointment in favour of her son. The mother of the applicant received communication dated 05.09.2016 (Annexure-A-8/A) from O/o respondent No.4 for submission of other documents/forms for consideration for her claim for compassionate appointment. The request of widow for consideration of case of her son Sh. Gaurav Jaswal for compassionate appointment was duly accepted by the competent authority and accordingly, vide communication dated 17.11.2016 (Annexure A-9), the applicant was advised to apply for appointment on compassionate grounds on prescribed format along with other required certificates which was duly submitted by the applicant to the O/o respondent No.4 vide his letter dated 27.12.2016.
