ORDER Per: RANJANA SHAHI, JUDICIAL MEMBER The present Original Application has been filed by the applicant praying for the following reliefs: -

"8.1 That by a suitable writ/order or the directions the respondents be directed to draw the sum of rs. 91,450/~ in favour of the applicant against the medical reimbursement bill of rs. 3,25,021/- as only a sum of rs.

2,33,571/- has been paid till the date.

8.2 Any other relief which the Hon’ble bench deems fit.”

2. Brief facts of the case, as stated by the applicant, are that Shri Gopal Lal Meena, who was permanent employee of B.S.N.L. was visiting his sister in Delhi with permission. There he suffered heart attack on 02.05.2010 and was admitted in Ayushman Hospital in New Delhi. The authorities of Ayushman Hospital referred him to Sir Ganga Ram Hospital. As such, medical expenditure of both the hospitals amounted to Rs. 3,25,021/-, for which he submitted the medical bills for reimbursement. When the same was not paid, Shri Gopal Lal Meena approached this Bench of the Tribunal by filing O.A. No. 291/00104/2015 and this Tribunal vide order dated 23.02.2015 directed the respondents to consider and decide the medical reimbursement of the applicant. Thereupon the respondents paid a sum of Rs. 2,33,571/- deducting an amount of Rs. 91,450/- from the claimed bill. In the meanwhile, Shri Gopal Lal Meena expired on 21.06.2015 and his wife Kamli Devi, the present applicant filed the present O.A. for payment of the balance unpaid amount of Rs. 91450/-.

The respondents have taken preliminary objection as to the locus of the applicant on the ground that as per office record and the details of the family members filled by the deceased employee Shri Gopal Lal Meena, the applicant was not his wife nor the family member of the deceased NATHU LAL Digitally signed by NATHU LAL employee, as while submitting papers for pension / family pension, the deceased employee had mentioned Smt. Soni Devi as his wife.

4. The second objection taken by the respondents is that the medical bill was settled and paid during the life-time of Shri Gopal Lal Meena who never challenged the same during his life-time, as such, it cannot be subsequently agitated.

5. The respondents have stated that since the representation was made by “unauthorized person” it did not deserved any reply.

The respondents have stated in para 5.1 of the reply that although the bill was duly signed by the hospital authorities but it does not entitle the payment as per the bill which is to be paid as per the Medical Rules of BSNL and according to the medical rules the respondents have already made the payment of Rs. 2,33,223 to the employee. They have stated in para 5.3 of the reply that in case the treatment is taken in private hospital, the claimant shall be entitled for reimbursement at CGHS rates only and accordingly, the payment was made.
