opposed to the Direction of Law and was an outcome of an Institutional Prejudice.
(ii) The Hon’ble Tribunal may be pleased to hold that in view of guidelines contained in para 4.4 of item IV in the Annexure to letter dated 28.06.2012, the impugned order created a stigma of being an officer with a doubtful integrity, based on an abject falsehood.
(iii) The Hon’ble Tribunal may be pleased to set aside the Impugned Orders of the Central and State Governments, as contained in paragraph number 1 and be pleased to issue Direction for restoration of his service from 13.08.2018 till 31.08.2019 and for payment for all consequential financial benefits.
(iv) The Hon’ble Tribunal may be pleased to award the Cost of litigation.
(v) The Hon’ble Tribunal may also be pleased to award compensation for the stigma on his integrity, which was based on an abject falsehood placed on record by the Home Department of the Government of Bihar.”
2. The applicant has also filed MA No. 711/2024 to amend the prayer for interim relief made in the OA.
3. The facts of the case, as per the applicant, are as follows:-
(i) The applicant was appointed to the IPS, 1985 batch of Bihar Cadre as a regular recruit. He was made to retire in public interest on 13.08.2018 ostensibly in exercise of powers provided in Rule 16(3) of the All India Services (Death cum Retirement Benefits) Rules, 1958, hereinafter referred to as AIS(DCRB) Rules, under orders of the State Government dated 13.08.2018 which was issued in pursuance of the order issued by the Central Government dated 18.07.2018. It is contended by the applicant that the said Rule provides for review of the service of those members of the All India Services (AIS) who have either (1) completed 15 years of service or (2) 25 years of service or (3) who have attained 50 years of age and have completed 5 years in the AIS. It is alleged that the applicant’s case did not fall under any of the aforesaid categories.
