ORAL ORDER

(As per Hon’ble Dr. Lata Baswaraj Patne, Judicial Member)

By this Original Application, the applicants sought the following relief:

“This Hon'ble Tribunal may be pleased to a). To set-aside the Impugned Memorandum of Prasar Bharathi in File No.TVH/8(5)2020-21 dated 18-06-2020.

b). And consequently declare the action of the respondents in not extending the benefit of Office Memorandum dated 17-02-2020 issued by the 6 Respondent in not including the applicants to come under Central Government (Pension) Rules, 1972 reckoning the date of initial engagement as casual make up assistant as arbitrary and illegal and violative of article 14 and 16 of Constitution of India.

c). And to grant any such other relief or reliefs) as this Hon'ble Tribunal deems fit and proper in the interest of justice including costs.”

2. The brief facts of the case are that, the applicants were initially engaged as casual Assistant Make-up Artists in Doordarshan Kendra, Hyderabad. Doordarshan Kendras were later brought under the provisions of Prasar Bharathi Act in the year 1990. Several employees were drawn from the Central Government on deemed deputation to the Prasar Bharathi. The employees, who were working in Prasar Bharathi, were not made eligible for pension.
