ORDER (ORAL)

The present OA has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking the following relief(s):

“(i) That the Hon’ble Tribunal may graciously be pleased to pass an order of quashing of impugned order dated 24.11.2023 (Annexure A/1) and consequently, pass an order directing the respondent No.3 & 4 to issue the appointment order to the applicant immediately with all consequential benefits including the notional seniority and notional fixation of pay from the date of appointment of junior and similarly situated persons.

(ii) That the Hon’ble Tribunal may graciously be pleased to pass an order of directing the respondents to consider the case of the applicant and similarly situated persons to relaxation of Essential qualification as per col.7 of the R.Rules, for considering their appointment to the post of Domestic Science Teacher.

(iii) That in case of not accepting the prayer (ii) of the applicant, the Hon’ble Tribunal may graciously be pleased to pass an order of quashing the quashed the R.Rules, for the post of Domestic Science Teacher notified on 23.05.2016 only to the extent of requirement of BA, degree with Home Science as a subject.

(iv) Any other relief which the Hon’ble Tribunal deem fit and proper may also be granted to the applicant along with costs of litigation.”

2. Factual Matrix

2.1 The present Applicant applied for the post of Domestic Science Teacher, post Code 88/20 as contained in the Advertisement dated 4.1.2020 issued by Respondent No.2. The Examination for the said recruitment was held on 26.07 2021. The applicant was short listed for the post code

88/20. After getting the e-dossier for the shortlisted candidates, the Respondent No.2 declared the final results on 5.1.2022. The applicant was one of the successful candidates under the SC category. Respondent No.3 issued the offer of appointment to the applicant vide their communication dated 15.6.2022 (Annexure-A2). The applicant accepted the offer of appointment and completed all the formalities like document verification. Respondent No.3 vide their communication dated 5.7.2022 (Annexure-A7) issued a deficiency memo to the applicant, stating that the essential qualification for post code 88/20 was Bachelors in Domestic Science/Home Science, however the applicant did not have equivalent degree in Domestic Science and accordingly the matter would be put up before Committee of Experts. The Expert Committee in their first Report dated 27.7.2022 (Annexure-R1) recommended the rejection of the candidature of the present applicant stating:
