By this application under Section 19 of the Administrative Tribunals Act , the applicant is seeking direction to the respondents to consider and accept the technical resignation of the applicant and relieve the applicant to join the post of Public Prosecutor in National Investigation Agency.

2. Shorn of details, applicant’s case is that he had applied for the post of Public Prosecutor in National Investigation Agency (NIA) vide Advertisement No. 16 of simultaneously applied for the post of Public Prosecutor in Central Bureau of Investigation (CBI) vide Advertisement No. 4 of 2021. The process of selection of Public Prosecutor in CBI was completed early owing to which applicant joined as Public Prosecutor in CBI on 31st October, 2022.

3. The selection process for the post of Public Prosecutor in NIA was also processed and the applicant came to be selected vide dossier dated 31st October, 2022 (Annexure - A-4) and he was issued an Offer of Appointment dated 30th April, 2024 for the post of Public Prosecutor vide Annexure A-5.
