Order By Hon’ble Mr. Rajnish Kumar Rai, Member (Judicial)

The applicants have approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985, seeking redressal of their grievance that despite being senior casual labourers duly reflected in the seniority list dated 23.04.1992, their services were not regularized, whereas several junior persons were granted regularization. Accordingly, the applicants pray for the following reliefs:—

“A. The Hon'ble Court may be pleased to allow the application and set aside the impugned order dt. 31.1.2011 (Annexure No. A-1) passed by respondent no.3 on behalf of respondent no.2.

B. The Hon'ble Court may be pleased to issue a direction to the respondents to provide employment to the applicants by absorbing them in the departments of Railway by way of regularising the services of applicant on class IVth under authority of respondents.

C. The Hon'ble Court may be pleased to issue a direction to the respondents to take the applicants back in job and to pay them the arrears of salary for period they were illegally kept employees and to regularised the services of the applicants w.e.f. dates of regularisation of the services of juniors persons mentioned in the above part of this application.

D. To pass any order or direction as this Hon'ble Tribunal may deem fit and proper on the facts and circumstances of the case in the interest of justice.

E. Award the cost of the application to the Applicants.”

2. The brief facts of the case are that Applicant No.1 Boley son of Badan Singh (Sl. No. 424), Applicant No.2 Narendra Singh son of Rajendra Singh (Sl. No. 339), and Applicant No.3 Bhajan Lal son of Lala Ram (Sl. No. 253) were engaged as casual labourers in the Agra Division of North Central Railway prior to 14.07.1981 and their names were duly reflected in the seniority list dated 23.04.1992. It is the case of the applicants that despite their seniority, their services were not regularized, whereas several junior persons—namely Chhidda (Sl. No. 435), Pitam (Sl. No. 361), and Kanhaiya Lal (Sl. No. 258)—were granted regularization. The applicants rely upon the judgment dated 01.01.2003 passed in OA No.761/1995 (All India Hot Weather Water Man Association v. Union of India), wherein the Tribunal had directed that senior casual workers shall be deemed regularized from the date of regularization of their juniors. Pursuant to directions issued in OA No.321/2007, the applicants submitted a joint representation dated 20.10.2009, which came to be rejected vide impugned order dated 31.01.2011 passed by Respondent No.3. The said rejection was allegedly made without obtaining the relevant records from DRM Jaipur, as directed by the Tribunal, and proceeded on erroneous assumptions regarding pendency of unrelated ID proceedings before CGIT/Kanpur. Aggrieved thereby, the applicants have approached this Tribunal seeking quashing of the impugned order and directions for reinstatement, regularization, and consequential benefits.

3. Learned counsel for the applicants submitted
