ORDER
Per: - Rajinder Singh Dogra, Judicial Member
1. The SWP/WP(C) No. 2036/2018 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as TA No. 61/2031/2020 by the Registry of this Tribunal.
2. The present matter was filed before the Hon’ble High Court with following prayer:
a) Mandamus, declaring Schedule-I attached to J&K Forest Service (Gazetted) Recruitment Rules, 1970, in so far as, it does not require 10 years of service as Range Officer Grade-I with M.Sc Forestry for promotion to the post of Assistant Conservator of Forest (Research) i.e. Class-III Category-D post same being ultravires to Article 14 & 16 of the Constitution of India, as for promotion to the post of Assistant Conservator of Forest (General) i.e. Class-III Category-A post, the rules require 10 years of service by Range Officer Grade-I for promotion to the aforesaid post.
b) Certiorari, seeking to quash Govt. Order No.127-FST/ 2007 dated 16.03.2007, whereby and whereunder, respondent No.4 was promoted/placed as Incharge Assistant Conservator of Forest (Research) in his own pay and grade.
c) Certiorari, seeking to quash recommendation of DPC/ PSC dated 12.02.2014, whereby and whereunder, recommendations were made for regularization of promotion of respondents No.3 to 6 with retrospective effect.
d) Certiorari, seeking to quash Govt. Order No.147-FST/ 2014 dated 23.04.2014, whereby and whereunder, private respondent No.3 to 6 were substantively promoted as Assistant Conservator of Forest (Research) with retrospective effect i.e. with effect from (i) 23.10.2009, (ii) 23.10.2009, (iii) 17.01.2011 and (iv) 17.01.2011 respectively;
e) Certiorari, seeking to quash Govt. Order No.175-FST/ 2015 dated 30.07.2015 whereby and whereunder, private respondent No.7 was promoted/placed as Incharge Assistant Conservator of Forest (Research) in her own pay and grade with retrospective effect i.e. w.e.f. 17.01.2011.
f) Certiorari, seeking to quash Govt. Order No.273-FST/ 2015 dated 09.10.2015, whereby and whereunder, the final seniority list of Assistant Conservator of Forest (General) and Research was issued, to the extent, private respondents are placed senior to the petitioner.
g) Certiorari, seeking to quash Govt. Order No.312-FST/ 2016 dated 26.12.2016, whereby and whereunder, the private respondent No.7 was substantively promoted/ regularized as Assistant Conservator of Forest (Research) with retrospective effect i.e. w.e.f. 17.01.2011 without having being physically put Incharge Assistant Conservator of Forest (Research) w.e.f. 17.01.2011, as is required under Rule 23 of Classification Control & Appeal Rules, 1956, law laid down by Hon’ble Supreme Court of India in case titled Suraj Parkash Gupta V/s State of J&K & Ors and as required under Govt. Order No.743-GAD of 2007 dated 28.06.2007.
h) Certiorari, seeking to quash Govt. Order No.144-FST/2018 dated 16.04.2018, whereby and whereunder, the representation filed by Assistant Conservator of Forest (General), including the petitioner for cancelling the retrospective promotion of private respondents as Assistant Conservator of Forest (Research) were rejected.
i) Certiorari, seeking to quash Govt. Order No.151-FST of 2018 dated 19.04.2018, whereby and whereunder, private respondent No.3 to 6 have been retrospectively promoted/placed as Incharge Deputy
