F709B6DE94E2153CCFD55F34387F3BB788E0F ORDER Per : Hon’ble Mr Justice Rameshwar Vyas Being aggrieved by not finding place in the select panel for the panel year 2012-13 & 2013-14 as also in the promotion cum posting order to the post of Foreman, the applicant working on the post of Chargeman-I filed this OA assailing the selected panel as also promotion cum posting order of respondent No. 6 (Annex. A/1 to Annex. A/5.)

2. The facts necessary to adjudicate this OA are as under:-

2.1 The applicant was appointed as Vehicle Mechanic (Civil) through direct selection process on 24.03.1981. Thereafter, he was promoted in the higher rank of Highly Skilled Mechanic Grade-II (HS-II) on 10.05.1989 & HS-I on 10.05.1992. He was further promoted to the post of Chargeman-II vide order dated 25.12.2004 w.e.f. 07.08.2004 and Chargeman-I w.e.f.

01.04.2008 in general category.

2.2 The applicant did not find place in the select panel drawn by DPC for the panel year 2012-13 and panel year 2013-2014 for promotion to the post of Foreman from the Chargemen-I (Part II Cadre) whereas the private respondent No. 6 Mr Shiv Kumar from SC category got promotion from the post of Chargemen-I to the post of Foreman which is a Group B Gazetted non-industrial post.

2.3 Aggrieved with the above, the applicant has assailed the Select Panel dated 11.06.2012 (Annex. A/1), promotion cum posting order dated 13.06.2012 (Annex. F709B6DE94E2153CCFD55F34387F3BB788E0F Forman, promotion cum posting order of private respondent No. 6 dated 20.03.2013 (Annex. A/3), Select Panel drawn by the DPC for the panel year 2013-14 dated May 2013 (Annex. A/4), as also circular dated 03.05.2012 (Annex. A/13) whereby ratio of authorization of Tech Supervisor in Part-I cadre and Part-II cadre was decided in Corps of EME, on the following grounds :

(a) The category of Part-I cadre and Part-II cadre of Chargemen forms the same class, have same pay scale and their next promotion post is Foreman which is a supervisory gazetted post and forms one class but the respondents have prepared different seniority roll for Part I cadre and part II cadre of Chargemen. In Part I cadre, ratio of 1:8 over the strength of technician is maintained whereas in Part II cadre (to which applicant belongs), ratio of 1:14 over the strength of technician is maintained. Meaning thereby, out of 8 technicians of Part I
