ORDER (ORAL)
PER: SURESH KUMAR BATRA, MEMBER (J):
The present OA has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 , seeking the following reliefs:-
“(i). That the record of the case be called for; in the interest of justice.
(ii). That the impugned Establishment Order No. 07/2010 dated 29.05.2020 to the extent the applicant listed at serial No. 59 therein, has been given Non-Functional Grade Pay (NFGP) in the grade pay of Rs. 5400/- w.e.f. 17.12.2018 (Annexure A-1/A) be quashed and set-aside, in the interest of justice, and consequently the respondents be directed to grant the applicant Non-Functional Grade Pay (NFGP) w.e.f. 06.02.2017 in terms of law laid down vide Judgment dated 06.09.2010 passed by the Hon'ble High Court of Madras in case of M. Subramanian vs. Union of India & others annexed as Annexure A-4 upheld vide A-5 & A-6 and A-7 upheld vide A-8 and office implementing office orders annexed as Annexure A-9, 11 & 12.
