By this Original Application, the applicants are seeking the following relief:

This Hon'ble Tribunal may be pleased to declare

the impugned notification of Transfer Policy 2023 dated 30-06-2023 without authority and approval of the Board of Governors as illegal, arbitrary, violation of Education Code prevailing in the Respondent organization and also being violative of Article 14, 16 & 21 of the constitution of India, against all canons of the service law and dictum passed by the Hon'ble Supreme Court of India in arena of cases and consequently direct the respondents to not initiate any transfer to the applicants under the Impugned Transfer Policy 2023 dated 30-06- 2023 and pass such other order or orders deem fit and proper in the circumstances of the case and in the interest of justice.

3. Shri K. Ajay Kumar, learned Standing Counsel for Kendriya Vidyalaya, is present and has submitted that the Transfer Policy, 2023, was issued on 28.06.2023 by the Hon’ble Shiksha Mantri and Chairman, KVS, and the same has been implemented throughout the country and several transfer have already been effected under it. The applicants have no locus to challenge a legally issued transfer policy. He has taken us through para 6, 18 and 19 of the Reply Statement to show that the said transfer policy was issued by the Hon’ble Siksha Mantri and Chairman of KVS, on 28.06.2023, and is annexed with the O.A. vide Ann.A-1. According to him, the applicants have not illustrated as to how the said transfer policy has prejudiced their service conditions.

4. Despite being granted several opportunities, Shri Shrikanth Chintala, learned Counsel for the Applicants, has either sought adjournment or simply failed to appear on several occasions. It is apparent that the applicants as well as their counsel are not interested in prosecuting the matter.

5. In view of the above, the O.A. is dismissed in default for non-prosecution. No order as to costs.
