ORDER (ORAL)
Per Hon’ble Mr. Pankaj Kumar, Member-Administrative In this case relating to crossing of efficiency bar, the applicants have sought following reliefs:
“(a) Issue order/direction/in the nature of certiorari quashing the order dated 22.07.2014 issued by respondent no. 3 for and on behalf of respondent no. 2 whereby the claim of the applicant for crossing the Efficiency Bar in 1990 has been rejected as contained in Annexure no.
1 (Compilation No. 1).
(b) Issue an order, direction and command to the respondents to permit the applicant to allow the efficiency Bar due on 01.06.1990 with a further prayer to direct the respondents to fix the pay of the applicant at appropriate place and also to pay the arrears thereof with interest @
18% per annum till the date of actual payment.
(c) Issue such other order/direction which may be deemed just and proper in the circumstances of the case.
(d) Allow the Original Application with cost against the respondents in view of the facts and circumstances, legal provisions and grounds raised in the application.”
2. The facts of the case are that the applicant Ram Mani Tripathi (now substituted by his legal heirs) was appointed by the respondents as Lower Division Clerk on 01.06.1980. His Annual Confidential Report (ACR, hereinafter) for the year 1990-91 contained certain adverse remarks due to which he was not allowed to cross efficiency bar due on 01.06.1991. The applicant represented on 02.06.1992 which was rejected vide memorandum dated 08.01.1996. He again represented on 21.03.2000 which was also rejected vide memorandum dated 14.09.2000. His subsequent representation dated 28.04.2003 was rejected vide memorandum dated 15.07.2003. Finally, the applicant represented on 25.02.2010 to expunge adverse remarks in the ACR for 1990-91 and the respondents expunged the adverse remarks vide memorandum dated 26.04.2011. However, his representations dated 23.11.2012 and 18.12.2013 for crossing efficiency bar were rejected vide the impugned order dated 22.07.2014. Aggrieved, the applicant has preferred this OA.
