In the present Original Application, the applicant has prayed for the following reliefs:

“(a) Quash the letter dated 04.09.2019 issued by the staff selection commission.

(b) Issue Direction to the respondent to issue JOINING LETTER/POSTING ORDER to the applicant to join_ the post of JUNIOR ENGINEER in CPWD as soon· as possible.

(c) Any other fit and proper relief.may also be granted to the applicant.”

2. Narrating the facts of the case, learned counsel for the applicant submitted as under:

2.1. The respondent authorities issued an advertisement for recruitment to the post of Junior Engineer (Civil, Mechanical, Quantity Surveying and Contract) Examination, 2014, which was published in the Rozgar Samachar dated 01.03.2014, clearly notifying 28.03.2014 as the last date for submission of applications. In response thereto, the applicant, being fully eligible and qualified, ANKIT ANKIT submitted his application along with the prescribed application fee on 27.03.2014, well within the stipulated time.

2.2. It was submitted that the Staff Selection Commission conducted the recruitment process in accordance with the notified procedure, pursuant to which the applicant was issued a call letter for interview. The applicant appeared before the Selection Committee and was interviewed on 12.10.2015 at 11:00 A.M. at the office of the Regional Director (NR), Staff Selection Commission, situated at CGO Complex, Lodhi Road, New Delhi.

2.3. The learned counsel for the applicant contended that upon successful completion of the selection process, the applicant was declared successful and, thereafter, received an offer of appointment from the office of the Chief Engineer, CPWD, R.K. Puram, New Delhi, informing him that he was being offered the post of Junior Engineer, with the proposed date of commencement of employment being 03.10.2017, subject to the terms and conditions set out in the offer letter.

2.4. It was further submitted that subsequently, the applicant was issued a formal appointment letter dated 15.03.2018 by the Additional Director General (Training), CPWD, which made reference to the applicant’s application and subsequent discussions and directed him to comply with the terms of appointment. In pursuance of the said appointment letter, the applicant was directed to report for training as part of the service requirements.

2.5. The learned counsel brought to the notice of the Bench that at the time when the applicant was required to report for duty, he unfortunately suffered a sudden medical emergency involving a paralytic attack, which resulted in weakness below the knees in both legs and difficulty in speech. The applicant immediately informed the competent authority in writing, explaining his medical condition, stating that he was undergoing treatment at AIIMS, and assuring the authorities that he would report back for duty immediately upon being declared fit by the medical practitioner. 2.6. It was submitted that, thereafter, the applicant was permitted to undergo the mandatory training. Accordingly, he attended and successfully completed the training conducted by the CPWD at Sewa Bhawan, R.K. Puram, New Delhi, from 11.02.2019 to 2
