O R D E R PER: HON’BLE MR. VARUN SINDHU KUL KAUMUDI, ADMINISTRATIVE MEMBER

1. The present Original Application has been filed by the applicant under Section

19 of the Administrative Tribunals Act, 1985, seeking the following relief:

“Quash and set aside the impugned order dated 11.12.2018 issued arbitrarily without any speaking order by the respondents and direct the respondents to issue for further proceedings to the applicant for appointment to the post of GDS BPM under PH(HH) quota in the AP Circle.”

2. It is a very sketchy OA. The facts, as per the submission by the applicant, are given below:

i. The applicant had applied on 08.05.2018 for the post of GDS BPM, under the PH (HH) Quota, in response to the notification, vide No.RE/APCO/3-11/2018, dt.25.04.2018, of India Posts in the Andhra Pradesh Circle. The total number of posts advertised was 2286 under the Andhra Pradesh Circle. The applicant was allotted Registration No.R821F479323B4. He was selected and was at S.No.1465, as per the results notified, and allotted to the Tadepalligudem Division under Kovvur H.O., Devarapalli S.O. (West Godavari), for Bandapram B.O., for the post of GDS BPM, under the PH(HH) Quota, as per SMS message, on 19.07.2018. However, the applicant was not called for certificate verification. He made a representation, on 07.10.2018, to the 4^th Respondent, requesting about further process. The 4^th Respondent, vide his letter, dt.22.10.2018, informed the applicant that the issue of the post of GDS BPM, Bandapuram BO A/W Devarapalli SO, is being pursued with higher authorities. Then, the applicant made a representation to the 2^nd Respondent, on 16.11.2018, requesting for issue of further proceedings. The 4^th Respondent issued the impugned order on 11.12.2018, without any speaking order. Hence, the OA.

3. The applicant had also sought the interim relief as under:

“Pending disposal of the above Original Application, it is prayed that this Hon’ble Tribunal in the interests of justice, suspend the impugned order dated 11.12.2018 and direct the respondents to keep one post vacant under HH quota and pass such other and further order or orders as are deemed fit and proper by this Hon’ble Tribunal in the circumstances of the case.”

4. This Tribunal had issued interim order, on 28.03.2019, as follows –

“3. Learned counsel for the respondents has opposed for grant of interim relief on the ground that the appointing authority has right to cancel any notification and, therefore, the plea of the applicant need not be entertained. On the other hand, learned counsel for the applicant has pleaded that the applicant who is physically handicapped, has been provisionally selected. x x x x. ..........the plea of the learned counsel for the applicant is that, the applicant can be considered for any other post coming under the jurisdiction of the respondents. He has prayed for reserving one post under Physically Handicapped quota till the OA is decided.

4. In view of the facts stated above, respondents are directed to keep one post under Physically Handicapped
