The applicant has filed this original application under Section

19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:

“a) Taking into account of the facts and legal position of the case on hand, this Hon’ble Tribunal be pleased to hold that applicant is entitled for increments in respect of his deputation period of 05 years duly approved foreign service and also for proforma promotion on par with the other panelists in the revised select panel published by the Department of Atomic Energy Centralized Cadre Section, Mumbai under its order No.1/7/2017-CCS/10724 dated

11.08.2017 Ann-A18.

b) Accordingly, this Hon’ble Tribunal be pleased to quash/set aside the orders bearing No.10/2/2018- CCS/12622, dated 30.08.2024, Annexure A7 and No.10/2/2018-CCS/12622, dated 30.08.2024, Annexure A7 and No.10/2/2018-CCS/1696, dated 30.01.2024, Annexure- A16, both passed by Dept. of Atomic Energy Government of India, Mumbai, R-1 herein.

CONSEQUENTLY c) (i) Direct the respondents herein to release the annual increments which became due in the normal course during the period from 26.02.2018 to 28.02.2023 along with the monetary benefits accruing thereof.

(ii) Direct the respondents herein to extend the proforma promotion benefit from May 2018 itself for the purpose of calculation of revision of pension and pensionary benefits along with the monetary benefits accruing thereof.

(iii) Direct the respondents to consider the claim of the applicant regarding his entitlement for the next promotion of Chief Administrative Officer on the basis of relief granted under (ii) above by holding review DPC relating to the promotion exercise to that cadre on par with his compares of the select panel to the grade of Administrative Officer-III as at Ann-A18 dated 11.08.2017 in Dept. of Atomic Energy Centralized Cadre Section order No: 1/7/2017-CCS/10724 dated 11.08.2017, Ann-A18 d) Pass any other order or direction that this Hon'ble Tribunal may deem it fit and necessary in the facts and circumstances of the present case and in the interest of justice and equity.”

2. Facts in brief as narrated by the applicant are that he joined Central Government service at Rare Materials Project (RMP) Mysuru, a unit of Baba Atomic Research Centre (constituent unit of Department of Atomic Energy (DAE) of Government of India) in the year 1985, While working as Section Officer in the Department Secretariat at Mumbai, the applicant sought permission of the Department to apply online for the position of Human Resources Officer in ITER (International Thermonuclear Experimental Reactor), Cadarache, France, vide request letter 11.10.2017. Necessary permission was granted to the applicant by the Department. Accordingly, applicant sent his application online on 12.10.2017.
