The applicants are the members of the Police Services Association and the officers of the State Police Services. They are aggrieved in not convening the cadre review in time for their induction into Indian Police Services (IPS) and, therefore, seeking direction to carry out a special cadre review for their induction into IPS.

2. Brief facts of the case, as projected in the Original Application are that for induction into the IPS from the State Police Services, the procedure is laid down in the Indian Police Services (Cadre) Rules, 1954 (hereinafter referred to as ‘1954 Rules’ for brevity). Rule 4(2) of these Rules stipulates that the Central Government shall at the interval of every five years re- examine the strength and composition of each cadre in consultation with the State Government or the State Governments concerned and may make such alteration therein as it deems fit.

2.1 A member of State Police Services holding the post of Deputy Superintendent of Police (DSP)/Additional Superintendent of Police (ASP) having continuous services of not less than 8 years is eligible to be inducted in the IPS subject to an age capping of 56 years.

2.2 At present, there are around 200 members of the State Police Services holding the post of DSP/ASP and have completed more than 08 years of service.

2.3 The exercise of cadre review is the statutory exercise of the Government and the Central Government is duty bound to carry out the same in every five years except for justified exceptions. Reliance has been placed in Union of India vs. Hemraj Singh Chauhan, (2010) 4 SCC 290, wherein it has been emphasize to under the cadre review exercise in every five years.

2.4 However, in the last 20 years, the exercise of cadre review is delayed for no reasons which has affected the officers of State Police Services for their induction into IPS. In para 4.16 of the O.A, the applicants have prepared a table, as per which the cadre review had taken place in 2003, 2010, 2015 and 2022 while the same was to be done at the interval of every five years. It has been stated by the applicants that between 2008 to 2023, the respondents have carried out only 3 cadre review while 4 cadre reviews were required to be done.

2.5 The applicants have further stated that the last inducted Deputy Superintendent of Police into IPS in the State of Madhya Pradesh was the officer of the batch of 1996 while in the other States, the State Police Services officers of 2010
