The applicant challenging the show cause dated 04.07.2012, order dtd. 11.10.2018 and order dated 27.03.2015 in the matter of termination from the post of GDS Packer, Kaniha SO on the ground that OBC certificate has not been attached along with the applicant has filed this OA praying for following reliefs:
a) To quash the show cause dt. 04.07.2012, 11.10.2012 &
27.03.2015 under Annexure A/5, A/8 & A/10 respectively.
b) To direct the respondents to reinstate the applicant forthwithin the post of GDS Packer in Kaniha SO i.a.w. Angul HO with all consequential service and financial benefits.
c) To pass any other order/orders as deem fit and proper.

The brief fact of the case as inter alia averred in the OA is that in pursuance to notification dtd. 25.10.2010 to fill up the post of GDS packer of Kaniha SO under Angul HO for OBC community, the applicant who belongs to Chasa caste which comes under OBC category in central Govt. list & SEBC in state Govt. list had applied for the said post. It is submitted that applicant had mentioned himself as OBC in the application form but at that time he had SEBC certificate and he had applied for OBC certificate. It is su3b mitted that Respondent No. 4 vide letter dtd. 20.12.2010 issued the order of appointment and after completion of four day training he was provisionally appointed as GDS Packer in Kaniha SO vide letter dated 27.12.2010. It is submitted that while continuing as such respondent no. 3 issued show cause notice dated 04.07.2012 stating therein that the respondent no. 3 while reviewing the recruitment file has cancelled engagement for the post of GDS/packer vide his letter dated 28.05.2012 furnishing reason that he has not submitted copy of OBC certificate as required under rule and instead has submitted copy of SEBC certificate which does not entitle for engagement under Govt. of India. It is submitted that applicant submitted his reply on 28.07.2012 stating that he submitted the certificate prior to selection before Respondent no. 4 and he did not commit any fraud. It is submitted that applicant had approached this Tribunal by filing OA No. 568/2012 and this Tribunal vide order dated 31.07.2012 had granted interim relief. It is submitted that Respondent No. 3 vide order dated 11.10.2012 stated that from personal file of the applicant it is found that the applicant has submitted OBC cer4ti ficate to the Inspector of Posts, Talcher Sub Division during submission of other allied documents and the said OBC certificate has been issued against the applicant on 09.12.2010 i.e. after the last date of submission of application. It is submitted that the said OA was dismissed vide order dated 03.12.2014 and the respondents vide order dated 27.03.2015 terminated the services of the applicant. It is submitted that applicant had approached Hon’ble High Court against the order of this Tribunal dated 03.12.2014 and Hon’ble High Court vide order dated 26.04.2022 was disposed of with liberty to the applicant to approach the Tribunal challenging the order dated 27.03.2015.
