In the present Original Application filed under Section 19 of the Administrative Tribunals Act , 1985, the applicant seeks the following reliefs:-
“(a) Set-aside the notes dated 03.06.2019 and 19.06.2019 issued by the Respondent rejecting the Applicant's prayer to transfer the bond;
(b) Direct the Respondent to transfer the bond of Rs.3,00,000/- plus GST & Cost of training (Rs. 83,000/- plus GST) to the Indian Railways Store Service (IRSS) under the Ministry of Railways (Railway Board);
(c) Pass such other order or further order or orders as this Hon'ble Court may deem fit and proper under the circumstances of the case.”
2. Brief facts of the case as narrated by learned counsel for the applicant are as under:-
2.1 The applicant was working with Delhi Metro Rail Corporation (DMRC). Prior to joining DMRC, he had already applied for and was undergoing a selection process conducted by UPSC for appointment under the Ministry of Railways through the Engineering Services Examination, 2018. The said selection process had commenced much prior to the issuance of the offer of appointment by DMRC.
