KABI S R Lo U e c a R a s Y t o io A n “(a) Order dated 20.12.2018 passed by Sr. Divisional Electrical Engineer (Operation), E.C. Railway, Mughalsarai, communicated to applicant vide letter dated 26.12.2018 by Law Officer for Sr. Divisional Personnel Officer, E.C. Railway, Mughalsarai as contained in Annexure- A/1 whereby the representation of the applicant dated 16.04.2018 has been rejected mechanically by a non-speaking order, may be quashed and set aside.

(b) The action of respondent authorities in inflicting compulsory retirement upon applicant w.e.f. 26.10.2010, without issuing/communicating any order to applicant, may be declared erroneous and bad in law and the same may be set aside with all consequential benefits.

(c) The applicant may be directed to be re-instated to his post with all consequential benefits allowing him to render his services upto

28.02.2020, the date of his age of attaining superannuation.

(d) Any other relief/reliefs, as the applicant is entitled and Your Lordships may deem fit and proper in the ends of justice”

2. The brief facts of the case, as per the applicant, are as follows:-

(i) The applicant started his service career on 18.08.1980 at Mugalsarai and was granted his due promotions. On 26.10.2010 while working as Loco Pilot Shunting at Mugalsarai, the applicant was verbally informed by Divisional Mechanical Engineer regarding order of his compulsory retirement without providing him even its copy. According to the applicant, his normal retirement on attaining the age of superannuation being 28.02.2020 he submitted repeated representations before the departmental authorities explaining all his grievances but in vain.

(ii) It is contended that only after RTI applications he was provided copy of his Service Book and Leave Sheet vide letter dated 25.07.2017 issued by Divisional Personnel Officer for Sr. DPO, E.C Railway, Mugalsarai (Annexure A/2) from where he came to know about his punishment of compulsory retirement. It is further submitted by the applicant that no procedure has been followed in his case and he has been made to retire prematurely without initiating any proceeding against him and that too about 10 years ahead of his actual retirement of attaining the age of superannuation.
