1. Present original application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985, seeking following relief:-

1) Quash Orders dated 01.07.2020 (Annexure A-1), dated 28.07.2020 (Annexure A-2) and dated 24.02.2021 (Annexure A-3) vide which the respondents have rejected the request of applicant for being granted exemption from typing test based upon Punjab Govt instructions dated 29.08.2018 (Annexure A-6) in continuation of instructions dated 01.10.1985 and 02.11.1989 adopted by respondents vide notification dated 06.11.2018 (Annexure A-7) read with Punjab Govt. instructions dated 18.02.2019 (Annexure A-9 Colly) adopted by U.T. Chandigarh vide notification dated 02.05.2019 (Annexure A-9 Colly), which provide to exempt the disabled from typing test on being certified by the Medical Board apart from other options to avail scribe and get extra time. Fact remains that no option to avail benefit of above instructions for getting exemption from typing test was given after result of written examination only before which a sole option was given to avail a scribe.

(ii) Declare that the procedure followed by respondents in the recruitment process qua applicant being PHD to the extent she has been subjected to typing test from which the applicant was exempted under the prevalent instructions, is bad, illegal, against the instructions on subject matter on dispute and violates the beneficial legislation as also statutory instructions and the same be treated as null and void qua her And Direct the respondents to consider and granted exemption to applicant from typing test based upon certificate of Medical Board exempting her from typing test due to level of her visual impairment and grant her

2. Briefly stated facts of the case are that respondents issued advertisement dated 29.09.2019 for filling up post of Clerks & Steno-Typists (English). The number of posts advertised under Persons with Benchmark Disabilities (PWD) Category were 14 out of total 356 posts. The criteria of filling up the post of Clerks was Written Test consisting of 200 marks of Objective type test of two hours. Qualifying Test in Typing on Computer for 10 minutes @ 35 words per minute. The University Institute of Applied Management Sciences, Punjab University, Chandigarh was engaged by the respondents for conducting examination. Applicant possessed M.A. degree in Psychology and is having certificate of ICT Skill Certification and is 75% visually impaired.

3. As per applicant, instructions dated 29.08.2018 (Annexure A-

6) was issued by the Govt. of Punjab, for granting exemption from type test to a candidate certified by Civil Surgeon, as being not capable to do typing due physical condition. The said instructions provided for giving extra time to the disabled who can type and were adopted by U.T. Chandigarh on 06.11.2018 (Annexure A-7) and subsequent instructions in this regard dated 18.02.2019 issued by State of Punjab were adopted by U.T. Chand
