1. The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act 1985, praying for the following relief(s):-
“a) An order directing the respondent authorities to settle the claim of the applicant for two advance increments on his acquiring higher technical qualification in the year 1990 from the date of his acquiring such qualification or from any later date as to this Hon’ble Tribunal may seem fit and proper;
b) An order directing the respondents to re-fix the pay of the applicant after granting two advance increments from the date as prayed for above and to grant him all consequential benefits with interest;
c) An order directing the respondents to produce/cause production of all relevant records;
d) To pass such other order or orders, direction or directions as Your Lordships may deem fit and proper”. Facts of the case.
2.1 The applicant was appointed as a Temporary Khalasi in the pay scale of Rs. 750-950/- in Chittaranjan Locomotive Works (CLW), Chittaranjan with effect from 17/02/1987(Annexure R4). He was transferred on his own request to the Howrah Depot of Chittaranjan Locomotive Works vide order dated 29/04/1989 (Annexure A-2).
2.2 The applicant acquired the higher qualification of Diploma in Mechanical Engineering after passing the examination conducted by the State Council for Engineering and Technical Education, West Bengal.
(Annexure A-3).
2.3 The applicant had submitted a representation dated 09/01/1997 through proper channel, to the Chief Personnel Officer, Chittaranjan Locomotive Works, Chittaranjan, praying for grant of two advance increments in terms of Railway Board letter dated 14/02/1990 (Annexure A-4).
2.4 The applicant was informed vide letter dated 15/05/1997 issued on behalf of the Chief personnel Officer that the incentive for acquiring higher technical qualifications is not admissible to Group D staff (Annexure A-5).
2.5 The applicant had submitted an appeal dated 25/08/2009, addressed to the Union Minister for Railways (Annexure A-6). The Executive Director, Railway Board vide letter dated 03/11/2009, addressed to the General Manager (P) CLW (Annexure A-6) asked for para-wise comments on the representation of the applicant addressed to the Union Minister for Railways.
2.6 The applicant submitted a further representation to the Chief Personal Officer, CLW, Chittaranjan dated 19/08/2013 (Annexure A-7) praying for grant of two advance increments on the ground that he had acquired higher qualifications and was entitled to the same in terms of /06/2000 (RBE No 124/2000).
