ORDER (Oral)

Hon’ble Mr. Manish Garg, Member (J) :

In the present O.A., the applicant seeks the following reliefs:

“a) Set aside the decision of the SSC Respondent No. 2 directing the Applicant to appear in the re-

examination dated 14.10.2025:

(b) Evaluate the marks of the Applicant's original examination in September, 2025 dated 20.09.2025:

(c) Consider the Applicant's scores per the original examination of Tier -1 of SSC CGLE 2025 for the purposes of SSC CGLE 2025 including selection to Tier-II; and (d) Any other order that this Hon'ble Tribunal may deem fit and proper in the facts of the case.”

2. The results have been produced by the respondents in a sealed cover, in accordance with the prior directions of this Tribunal. Upon being opened in open court, it is observed that the applicant has successfully qualified in the Tier I Examination.

3. In light of this development, learned counsel for the applicant seeks the permission of this Tribunal to withdraw the present Original Application (OA), stating that the primary relief sought has been effectively addressed by the applicant’s qualification.

4. However, learned counsel for the respondents raised an objection, submitting that the applicant should not be permitted to proceed to the next stage, as the initial prayer in the OA sought the cancellation of the examination process entirely. It is contended that the applicant cannot now seek to benefit from an examination the validity of which they had previously challenged.

5. In view of the above, the respondents are directed to permit the applicant to participate in the upcoming Tier II Examination and to complete all necessary formalities in this regard.

6. The present interim relief has been passed in the presence of learned counsel for both the parties. The learned counsel for the respondents is directed to convey the interim order passed in the matter to the competent authority for taking further necessary action.

6. Accordingly, the OA is dismissed as withdrawn. Pending applications, if any, shall stand disposed of. No order as to costs.
