1. The instant Original Application has been filed by ld. Counsel for the applicant for the following relief:
(i) To declare the impugned action of the Respondents showing the reason for denying the Applicant of his due promotion in the Higher Administrative Grade (Non Functional) with effect from 29.07.2015 as contained in Annexure-A/1 as null, void, ab-initio wrong as no Order has been issued by the DOP&T for denial of promotion on the said reason as has been shown in Annexure- A/3 dated 13.01.2016 and as such any adverse Letter/Instructions including 11.06.2010 issued by the Railway be quashed and be declared ultra virus.
(ii) To direct/command the Respondents to issue similar Order in favour of the Applicant for promotion to the Grade of Higher Administrative Grade (Non Functional) at par with other Officers shown in Annexure-A/1 including Sri K. Seshasayi, SAG/IRPS/SCR who has also been granted with the same benefit of HAG (NF) after his retirement as evident from Annexure-A/6.
(iii) The Respondents be further directed to grant all consequential benefits in favour of the Applicant together with arrears of salary from 29.07.2015 to
