This is the third round of litigation. The instant OA has been filed by the applicant under section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-

"(a) Pay incentive increments which are admissible to the applicant because of his outstanding performance at the national events as per railway board circular in terms of which the applicant is entitled to three additional increments. (b) Pay arrears for promotion of Grade-II with effect from 1999 and next higher grade of Head TTE from 2008 from which date the applicant has been given promotion as Sr. TTE as well as Head TTE. That the Hon'ble Tribunal may further graciously be pleased to pass any other or further order as may be deemed fit and proper on the facts and circumstances of the case.

(c) That the Hon'ble Tribunal may further be graciously pleased to grant costs against the respondents and in favour of the applicant.”

2. The conspectus of the case as per the counsel of the applicant is that the applicant was appointed as a Ticket Collector on 29.06.1996 under Sports Quota. He was a national level outstanding athlete of Northern Railway and had secured various medals in All India Open Athletic Championships on different dates. He drew our attention to the Railway Board Circular dated 20.06.2006 which speaks about instructions for appointment, promotions and special incentives to the sportspersons. He highlighted para 9.4 of the said circular wherein provision for providing out of turn promotions to be given to the outstanding sportsperson with certain conditions has been mentioned.

Even though he won 9 medals and represented the authorities however, he was deprived of out of turn promotions as per para 9.4 of the said circular. Feeling distressed, he approached the Chandigarh Bench of this Tribunal vide OA No. 434/PD/2007 and prayed for grant of admissible benefits to him. The said OA was disposed of on 31.03.2008 with a direction to the applicant to make a representation to respondent no. 3 along with copies of the relevant certificates within two weeks. Direction was also given to the respondents to pass a detailed speaking order under intimation to the applicant. Pursuant to which the applicant represented to the competent authority. However, even after making such a representation, he was not promoted w.e.f. 1999 but was promoted a TTE w.e.f. 06.08.2001 and that too on seniority basis. Aggrieved, the applicant again filed OA No. 612/PB/2008 which was allowed vide order dated 16.08.2010 with a direction to the respondents to consider the case of the applicant for grant of ‘First out of turn Promotion’ from the due date within three months. However, the respondents did not comply with the said directions and rather preferred an appeal – CWP No. 4406-CAT/2012 before the Hon’ble Punjab & Haryana High Court which was disposed of on 16.03.2011. Thereafter, the respondents vide communication dated 07.07.2011 took a decision to implement the judgment and not to move to the Hon’ble Apex Court. Pursuant to which, the applicant was promoted as Sr. Ticket Collector w.e.f. 31.10.1999 and was assigned proper seniority also at Sl. No. 111-A.
