Through this Original Application the applicant is not challenging any particular order but is aggrieved against the respondents in not providing family pension to the applicant.

The case of the applicant is that the applicant’s husband Late Ramlal was a Mashal Man under the management of respondents who died unfortunately vide Annexure A/1 dated 18.05.2017 leaving behind applicant and his children’s. After the death of her husband, when the applicant approached to the respondents No. 2 for providing family pension, the respondents were silent, then the applicant had filed an O.A. No. 200/659/18 and in that O.A. vide Annexure A/2 dated 22.04.2019 an order have been passed by the Tribunal to consider and decide the matter of the applicant with a reasoned and speaking order. In pursuance of Court’s Order dated 11.07.2019, the respondents compelled the applicant to obtain declaration certificate. The applicant approached to the Civil Court through declaration suit which was decided on 26.11.2022 vide Annexure A/4 in favour of applicant and it has been proved and declared that both are one person i.e. Ramkali @ Usha. After that the applicant preferred representation vide Annexure A/6 dated 20.02.2023, but yet

3. Per contra, the respondents have filed their reply wherein it has been submitted that the husband of the applicant namely Ramlal Netam was posted under the control of Station Superintendent. He had taken voluntary retirement on 02.05.1994, He died on 18-05-2017. Late Ramlal Netam at the time of his retirement mentioned the applicant name as his wife in the description of family pension of form No.6 of the last settlement book. To enter name of wife of employee in Settlement book as nominee for providing family pension to nominee in future Joint photo of husband (employee) and wife (who is to be mentioned as nominee in settlement book), birth certificate, joint bank account etc. are necessary. At the time of last settlement, the employee/husband of the applicant has not provided the said necessary documents to the office. Therefore, in the absence of the said documents, the name of the applicant has not been recorded as his nominee for granting pension/family pension. It is pertinent to mention here that the employee vide letter dated 27.04.1994 had informed to the administration that his wife is detained in jail in connection with 'Deva Kand' case, therefore, after her release, the said documents will be provided. But, neither the applicant nor deceased employee before his death i.e. 18-05-2017 provided required documents to the department nor informed about that the order dated 22.04.2019 passed by this Tribunal in O.A.No.200/00659/2018 wherein it was directed to consider and decide the representation of the applicant has been complied with by the respondents vide letter dated 11-07-2019 which was communicated to the applicant wherein to resolve the issue of differences in name of the applicant in various documents submitted by her, the applicant was directed to get declaration from the competent court that the applicant Ramkali, Usha Thakar Netam and their children are the wife and children of late Ram Lal.
