Heard the learned counsel for the applicants on the question of admission as also on MA No.66/2026, which is an application filed by the applicants seeking prosecution of the present OA jointly, as common cause of action accrued to them to file the present OA. Considering the aforesaid submission, MA No.66/2026 is allowed

2. The matter pertains to grant of notional increment based upon the order passed by the Hon’ble Supreme Court in the case of the Director (Admn. And HR) KPTCL & Ors. Vs. C.P. Mundinamani & Ors., 2023 SCC Online SC 401 and in the case of Union of India & Anr. Versus М. Siddaraj, MA Diary No.2400/2024 in Civil Appeal No.3933/2023 dated 20.02.2025 and the same has been implemented by the DoPT by way of OM dated

20.05.2025.

3. It is submitted by the learned counsel for the applicants that in pursuance of the orders passed by the Hon’ble Supreme Court, the DoPT has issued OM dated

14th October, 2024.

4. Since the issue is already settled up to the Hon’ble Supreme Court, therefore, we deem it proper to take up the matter for final disposal at the admission stage. 5. The applicants have retired on superannuation on 30th June, 2012, 30th June, 2020, 30th June, 2015, 30th June, 2020, 30th June, 2019, 30th June, 2011, 30th June, 2020 & 30th June, 2020 respectively. They are claiming notional increment which they claim was due to them on 01st July, 2012, 01st July, 2020, 01st July, 2015, 01st July, 2020, 01st July, 2019, 01st July, 2011, 01st July, 2020 and 01st July, 2020 respectively. The applicants submitted representation to the respondents. The same was rejected. Hence, this OA.

6. Learned counsel for the applicants has placed reliance on the decision of Hon’ble Supreme Court in the case of Union of India & Ors. Vs. P. Ayyamperumal Special Leave Petition (Civil) Diary No(s).22283/2018 dated 23.07.2018 whereby the order of Hon’ble
