ORDER

Per : Hon’ble Mr Justice Rameshwar Vyas

Being aggrieved by the termination order dated

26.04.2017 (Annex. A/1) whereby the applicant’s services has

been terminated under Para 512 sub note 2 (ii) of IRMM 2000

from the post of Assistant Station Master (ASM), the applicant

has preferred this OA to quash and set aside the above order as

also the order of appellate authority dated 21.02.2019 (Annex.

A/3) rejecting the appeal filed by the applicant.

2. The facts necessary to adjudicate this OA are as under:-

2.1 The applicant was initially appointed to the post of ASM on

20.12.2012. He was subjected to the medical examination and

found fit in Aye Two (A-2) category.

2.2 While posted at Diyatara Road Railway Station Kolayat

Phalodi Section, he was sent for a periodical medical

examination held on 06.06.2016. As per medical certificate

(Annex. A/4), advice was made to keep him in sick list for the

illness of defective colour vision; he was issued a sick certificate

for 30 days on 08.06.2016 (Annex. A/5).

2.3 Since he was found having defective colour vision, he was

referred to Sr. D.M.O. (Ophthalmology) Jaipur. He was seen by

Sr. D.M.O. (Ophth) who advised that he should be sent to BAM

Hospital Byculla for a colour vision package test. His colour

vision package test was done at BAM Hospital Byculla on

(Opth.) finally opined that his colour vision package test shows

mild deutranomalous trichomatrism. On EGL (13 mm) he reads

yellow as red – colour defective. Thereafter, the Chief Medical

Superintendent, N.W. Railway, Bikaner referred the case as per

IRMM 2000. Thereafter, the Medical Board was constituted

which in its meeting held on 03.11.2016 opined that there is a

lot of variation in perception of colour vision at different places,

therefore, Sh. Satyendra Kumar s/o Sh. Gupteshwar Prasad is

malingerer for colour vision as there is a lot of inconsistency.

Hence, he may be dealt as per Para 512 sub note 2(ii) of IRMM

2000.
