ORDER

Hon'ble Dr. Sumeet Jerath, Member (A):

The instant OA has been filed by the applicants under section 19 of the

Administrative Tribunals Act, 1985 seeking the following reliefs:-

"i) That the Hon'ble Tribunal may graciously be pleased to pass an

order of quashing the impugned order dated 12.11.2013(A/1) only

to the extent by which the applicants have not been granted their

promotion to the post of Joint Commissioner of Income Tax from

due dates and consequently, pass an order directing the

respondents to grant the promotion to the applicants to the post of

Joint Commissioner of Income Tax from 23.9.2010 j.e. from the

date of DPC or alternatively, from 30.03.2011, the date from which

the applicants were directed to officiate as JCIT (OSD) in various

field formations of the respondent, or atleast from 6.7.2012 i.e.

from the date of the judgment of the Hon'ble Delhi court with all

the consequential benefits.

(ii) That the Hon'ble Tribunal may graciously be pleased to pass an

order of quashing the impugned order dated 28.2.2014(A/2) only

the extent by which the applicants have been granted Selection

Grade(Non-functional) w.e.f. 12.11.2013 and consequently, pass

an order directing the respondents to grant the Selection

Grade(Non-functional) to the applicants w.e.f. 1.1.2013 with all

the consequential benefits including the arrears of difference of

pay and allowances with interest.

(iii) Any other relief which the Hon'ble Tribunal deem fit and proper

may also be granted to the applicants along with the costs of

litigation.”

2. The factual matrix of the case as per the counsel of the applicants

is that the applicants were directly recruited officers of 2000 batch of Indian
