The applicant, Kumari Parbati Sing stating to be the

daughter of Late Budharay tSoi ntgh e@ r eBsupdohnudreaynats S tion gshto hpa sth feil efda mthiliys

Late Budharay Sing @ Budhuraya Singh and to direct the

respondents to grant 50% family pension in her favour INTER

ALIA

stating that she is the unmarried, unemployed daughter

born out of the wedlock of first wife of Late Budharay Sing @

Budhuraya Singh. After the death of her father, she has been

leading destitute life since the entire family pension has been

sanctioned in favour of her step mother, who is no taking care of

her. It is stated that she submitted representation on 09.02.2023

before the competent authority of the Railway praying for

sanction of 50% of the family pension in her favour but deaf ear

shown by the authority made her to approach before this Bench

praying for aforesaid relief, which may be granted in her favour.

2. Notices were issued to all the respondents but no

any such reply is received from her. However, official

respondents filed their counter stating that Late Budharay Sing

@ Budhuraya Singh was working in the Railways. As per records,

his first wife [Jiki Sing] expired while he was in service. ON

verification of record it is found that Late Budharay Sing @

Budhuraya Singh before his retirement had declared Mina Sing

as his wife. On examination of records, it is found that one Sri

Budhurai, S/o Iswar, was working as Trolley Man in Engineer

Department of the railway. Smt. Mina Sing, whose DoB is

22.08.1950, at the time of his retirement, was declared as his

legally married wife. Late Budhurai, S/o Iswar, retired from

railway service on 31.10.2005 and PPO No. 20057070100883

was issued to him containing his name and the name of his

legally married wife, Smt. Mina Sing. It is stated that in this way

the applicant stated her father’s name as “Late Budharaya Sing @

Budhuraya Sing”. In the death certificate his name is shown as

Budhuraya Singh and in Legal Heir Certificate the name shows as

Budhray Singh whereas as per the service record, the name of

the ex-employee is “Budhurai, S/o Iswar”. It is stated that the

Legal Heir Certificate produced by the applicant is obtained by

her on 04.01.2023 wherein the name of “Mina Sing” is shown as

the widow of “Late Budhuray Singh, S/o Iswar Singh” and also

her age is shown 35 years as on the date of issuance of the said

certificate i.e. 04.01.2023 whereas as per the record, Smt. Mina

Sing [wife of Budhurai] is aged about 72 years, 4 months 12 days

as on
