ORDER

1. The SWP No.241/2020 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.241/2020 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

a) Writ, order or direction in the nature of Certiorari, quashing the order No. 252-SSB of 2019 dated 14.10.2019 passed by the respondent No. 5 whereby the claim of petitioner for selection and appointment against the unfilled vacancy of Accounts Assistant, State Cadre advertised vide advertisement notice No. 10 of 2013 dated 10.10.2013 under ALC category, as had remained unfilled on account of cancellation of selection of the candidate selected there-against, has been rejected, despite petitioner being the candidate next in order of merit.

b) Writ, order or direction in the nature of Mandamus, commanding the respondents Nos. 4 and 5 to select and recommend the candidature of petitioner against the unfilled state cadre post of Accounts Assistant advertised vide advertisement notice No. 10 of 2013 dated 10.10.2013 under ALC category, as has remained unfilled on account of cancellation of selection of the candidate selected there against by the respondent No. 5. petitioner being the candidate next in order of merit;

c) Writ, order or direction in the nature of Mandamus commanding the respondents Nos. 4 and 5 to similarly recommend the candidature of petitioner against the unfilled state cadre post of Accounts Assistant advertised vide advertisement notice No. 10 of 2013 dated 10.10.2013 under ALC category, as has been done in case of the candidates namely Firdous Ahmad Kasana and Ab. Waheeb Hajam referred to in paras 18(g) and 18(h) of the writ petition;

d) Writ, order or direction in the nature of Mandamus commanding upon the respondents Nos. 1 to 3 to, consequently, appoint the petitioner against the unfilled state cadre post of Accounts Assistant advertised vide advertisement notice No. 10 of 2013 dated 10.10.2013 under ALC category, with all consequential benefits w.e.f. the date other selectees of the same selection process have been appointed;

e) Any other writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, may also be granted in favour of the petitioner and against the respondents along with cost of the petition.

3. The facts of the case as pleaded by the petitioner in his pleadings are as follows: -

a) The present Transfer Application arises out of SWP No.241/2020 , originally filed before the Hon’ble High Court of Jammu & Kashmir at Jammu and later transferred to this Tribunal for adjudication. The applicant, Satvinder Singh, seeks selection and appointment to the post of Accounts Assistant (State Cadre) under the ALC category pursuant to Advertisement Notice No. 10 of 2013 dated 10.10.2013 issued by the Jammu & Kashmir Services Selection Board.
