1. The SWP No.702/2020 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.510/2020 by the Registry of this Tribunal.
2. The present matter was filed before the Hon’ble High Court seeking following relief: -
It is, therefore, respectfully prayed that in view of the submissions made hereinabove and those to be urged at the time of arguments, the Hon'ble Court may very kindly be pleased to:-
i) stay the selection of the private respondents for the post of Radiographic Technician, (Health and Medical Education Department (GMC Rajouri), Divisional Cadre, Jammu advertised vide advertisement notice No.04/2019 /001 to 04/2019/041 dated 01-02-2019 issued by the respondent No.2 being illegal, arbitrary, malafide and against the principles of natural justice.
ii) direct the official respondents to select and appoint the petitioner for the post of Radiographic Technician, (Health and Medical Education Department (GMC Rajouri), Divisional Cadre, Jammu being the meritorious and highly qualified candidate for the said post.
iii) direct the respondents to reframe the select list in accordance with the merit position of the candidates as per the merit list of written test and recommend appointment of meritorious candidates in the order of merit.
Any other writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case may also be passed in favour of the Petitioner.
3. The facts of the case as pleaded by the petitioners in their pleadings are as follows: -
a) The present Transfer Application arises out of SWP No.
702/2020, originally instituted before the Hon’ble High Court of Jammu & Kashmir at Jammu, which upon transfer stood registered as T.A. No. 510/2020 before this Tribunal. The applicant assails the final selection list dated 25.02.2020 issued by the Jammu and Kashmir Services Selection Board (JKSSB) in respect of the post of Radiographic Technician, Health and Medical Education Department (GMC Rajouri), Divisional Cadre Jammu, advertised under Advertisement Notification No.
04 of 2019 dated 01.02.2019.
b) Pursuant to the aforesaid advertisement, four posts of Radiographic Technician under Open Merit category were notified. The prescribed qualification, as reflected in the advertisement notice, was 10+2 with Science or above qualification along with a two-year Diploma in X-Ray Technician/Radiography from a recognized institute/SMF. The applicant, possessing a Bachelor’s degree in Radiation and Imaging Technology, applied for the post and participated in the selection process, including the written examination conducted on 11.05.2019.
c) Upon evaluation of the written test, a provisional list dated
05.10.2019 was issued for document verification, wherein the applicant figured at Serial No. 9 in the Open Merit category with a total of 62.25 points. During the course of the selection process, the JKSSB sought clarification f
