Shri Pramod Kumar Pandey, learned counsel for the applicants and Shri Rishi Kumar, learned counsel for the respondents, are present.

2. The instant original application has been filed by the applicant seeking following relief:

“(i) The Hon’ble Tribunal may graciously be pleased to issue necessary direction in the nature of mandamus and pass appropriate orders by taking a decision not to allow RPF / RPSF Personals to appear in General Department Competitive Examination (GDCE).

(ii) Issue an order or direction commanding the respondent to implement the circular dated 11.08.2003, 24.03.2004 and 13.10.2004 & revised the seniority list as per the policy.

(iii) The Hon’ble Tribunal may be pleased to pass any other order or relief which this Hon’ble Tribunal may deem fit to award to the applicant in circumstances of the case.”

The instant original application has been filed by the applicants alleging that their valuable right is being affected as RPF / RPSF personnel are being allowed to appear in the General Department Competitive Examination (GDCE) which is against the law and contrary to the provisions contained in circulars issued by the department on 11.08.2003, 24.03.2004 and 13.10.2004 which elaborates that such personnel are not eligible to appear in the aforesaid examination. Thus, by way of this original application, the applicants have prayed for a direction to the respondents’ department to not allow the RPF / RPSF personnel to appear in the GDCE and also to direct the respondents to implement their circular dated

11.08.2003, 24.03.2004 and 13.10.2004.

4. Heard learned counsel for the parties on the issue of admission. 5. Learned counsel for the applicants submits that in several decisions of the Hon’ble Supreme Court of India, Hon’ble High Courts and Tribunals, issue has been decided that RPF / RPSF personnel be not permitted to appear in General Departmental Competitive Examination (GDCE) of the Railways department. To substantiate this argument, learned counsel for the applicants referred to the documents annexed with the OA and also other judgments passed in this respect. Learned counsel for the applicants also argued that since respondents (Railway department) are not following the decisions of the Courts / Tribunals thus a direction be issued to the respondents as claimed in Relief No 8(a). He also argued that direction be also issued to the respondents to implement the Circular dated 11.08.2003, 24.03.2004 and 13.10.2004 and to revise the seniority list as per the policy. Learned
