The applicants, challenging orders relating to withdrawal or financial upgradations and subsequent recovery, have filed this OA pr“aay) iTnog qfoura sthh et hfeo lloordweirn ugn rdeelrie Afsn:n exure A/19, A/22, A/23 and A/24.
b) To direct the respondents to restore/grant financial upgradations to the applicants under TBOP scheme after completion of 16 years of service which was granted to them as per Annexure-A/17 & consequently grant financial upgradation under BCR scheme after completion of 26 years of service from the dates from which their juniors are granted such financial up gradation.
c) To direct the respondents to revise/refix/restore the pay of all the applicants and consequently revise the pay and consequently refix their pension and other pensionary benefits and to refund to all applicants the amounts recovered/withheld from their retirement gratuity etc.
d) to direct the respondents to make payment of arrears of pay and allowances due to applicant No.5 and 6 as per annexure-A/17 and consequently revise their pay, pension and other pensionary benefits accordingly.
d) To pass such other order(s)/direction(s) as may be deemed fit and proper in the bonafide interest of justice.”
2. Respondents filed counter contesting and opposing the case of the applicant and the applicant has also filed rejoinder to the same.
3. Heard Ld. Counsel for both sides. In course of hearing, Ld. Counsel for the applicants has submitted that similar facts and issues involved in this OA camHee mupa nfot rK cuomnasird Pearantii o&n O bresf oVrse UthOisI &be Oncrsh in OA No. 288/2021 ( Muralidhar Naik & Ors Vs UOI & Ors) and in OA No. 355/2021 (
). The respondents department also filed their counter in those cases contesting and opposing the claim of the applicants therein. However, this Bench, after examining the matter in its entirety, allowed the OA No. 288 of 2021 vide order dated 18.12.2024 and OA No. 355/2021 vide order dated 18.12.2025.
