ORDER (ORAL)

By way of the present O.A. the applicant seeks

following reliefs:-

“a) To quash and set aside the impugned reply of the

respondents no. 2 bearing no. 11.01.2024 EDP dated

22.02.2024, Annexure A/1 w.r.t. the non-selection of

the applicant in the recruitment process to the post of

Head Constable (Ministerial}.

b) To quash and set aside the result dated 27.12.2023

Annexure A/2 of the Head Constable (Ministerial) in

Delhi Police

c) To declare the applicant eligible as per the marks in

the final result of the head constable (ministerial) in the

Delhi police examination published/uploaded on

07.02.2024 Annexure A/3 result and allow the

applicant to join the service with the respondents as per

his merit.

d) Pass such other further order(s) as this Hon'ble

Tribunal deems fit and proper, under the facts and

circumstances of the case and in the interest of justice.”

2. Highlighting the facts of the case, learned counsel for

the applicant would submit that it is the case of the he

had applied under the Scheduled Tribe (ST) category. It

is not in dispute that the applicant applied for the post of

Head Constable (Ministerial) in Delhi Police Examination,

2022. Pursuant thereto, in the year 2022, the applicant

participated in the Tier-I Computer Based Test held on

21.10.2022 under the ST category and qualified the

same. After qualifying the computer-based examination,

the applicant was permitted to participate in the Physical

Endurance and Measurement Test held on 15.03.2023,

appeared in the Typing Test (Computer Based) held on

17.10.2023, which was also cleared by him.

Subsequently, the applicant appeared in the Computer

Formatting Examination held on 04.12.2023, which he

duly qualified. The details of the applicant having

qualified all stages of the examination are reflected at

page 41 of the paper book.

2.1. The final result of the Head Constable (Ministerial)

examination was declared on 27.12.2023, wherein the

last selected candidate under the ST category secured

72.80176 marks, whereas the applicant secured

75.27756 (60.27756+15) marks after normalization.

Despite having secured 75.27756 marks which are

higher than the last selected candidate, namely Veer

Singh, who secured 72.80176 marks, the applicant was

not selected. Aggrieved thereby, the applicant submitted

a representation by way of an email dated 08.02.2024,

followed by various reminders addressed to the Director,

Staff Selection Commission, New Delhi.

2.2. However, vide the impugned office order dated

22.02.2024, the candidature of the applicant was

rejected by the respondents making following

observations (as per the typed copy of Annexure-A/1):-
