Per: - Rajinder Singh Dogra, Judicial Member

1. The applicant has filed the present Original Application under Section

19 of the Administrative Tribunals Act, 1985 seeking the following

reliefs: -

a) Quash the Orders (i) No.DDEO/U/24/1150 dated 30-09-2024

passed by the respondent No.2 by virtue of which the applicant

was placed under suspension with immediate effect and (ii)

No.DDEO/U/24/1268 dated 22-10-2024 passed by the

respondent No.2 by virtue of which the suspension order dated

30-09-2024 was revoked by imposing a punishment of stopping

next annual increment of the applicant with direction to the

respondent No.4 to 6 to record the entry with respect to

stoppage of next annual increment in the service book of the

applicant.

b) Direct the respondents to treat the applicant on duty during his

suspension period and also to remove the entry with respect to

stoppage of next annual increment from the service book of the

applicant.

c) Any other order which this Hon’ble Tribunal may deem fit and

proper may also be passed in favour of the applicants and

against the respondents.

2. The facts of the case as averred by the applicant in his pleadings, are

as follows: -

a) The applicant, Jaswant Singh, is a permanent resident of the

Union Territory of Jammu and Kashmir and is presently serving

as a Teacher in Government Primary School, Kothi, Zone

Chenani, District Udhampur, for the last more than thirteen

years. His appointment to the said post was made by the Zonal

Education Officer, Chenani, with the approval of the competent

authorities, namely the Director School Education, Jammu and

the Chief Education Officer, Udhampur, and the Zonal

Education Officer continues to be his appointing and

controlling authority.

b) During the year 2024, the applicant was allegedly appointed as

a Booth Level Officer (BLO) for Polling Station No. 61-40

(Narsoo) in connection with elect
