The instant original application has been filed under Section 19 of
the Administrative Tribunals Act, 1985, seeking the following
relief:
“In view of the facts and circumstances stated above and
grounds mentioned therein the applicant is entitled for relief

sought before this Hon’ble Tribunal and this may further be
pleased to direct the respondents to consider the grievance
of the applicant for job within any certain time.”
3. Heard learned counsel appearing for both the parties on the point
of maintainability.
4. Submission of learned counsel for the applicant is that the land
belonging to the applicant was acquired under a special rail
project by the Dedicated Freight Corridor Corporation of India
Ltd. According to Section 20 E Amendment Railway Act 2008 the
Araji No.267 of the applicant situated in Mauja Keshavpur was
acquired by the Railway Department for Railway Project. There is
a provision for giving employment to one competent member of
the family in the Railway Department in lieu of the acquired land
as per the Land Acquisition Act. The Deputy Chief Project
Manager, D.F.C.C.I.L., Mughal Sarai communicated to the
District Magistrate for the appointment in lieu of the land acquired
for project on 09.03.2011. In respect of the land acquisition and
for their compensation the notice was issued through the
competent authority / A.D.M. (Finance) for objection, if any, with
regard to the compensation as well as providing a job in lieu of the
land acquired for the purpose and the petitioner appeared before
the authorities concerned and submitted his objection on
23-08-2011. For providing the job to the land looser the news item
published in the daily news paper dated 01-11-011 stated that the
land looser should be given a job for which the order already has
been issued disclosing the terms and procedure for the same. It is
submitted by learned counsel for the applicant that on the basis of
objection and after hearing both the parties an office order was
issued from the office of competent authority / Upper Ziladhikari
(Finance & Revenue) on 08-11-2011 mentioning therein that
applicant will be given compensation according to present market
value or circuit rate whichever is more according to Railway
Amendment Act 2008 and house compensation rate fixed by
P.W.D. and appointment of one member of the aggrieved family

according Govt. Order no. E(NG) 11/10 R.C.-5/1 dated
16-07-2010 issued by the Railway of Ministry and Board. The
applicant again filed his objection on 17-02-2012 and 19-09-2012
annexing copy of khasra and khatauni.
5. Learned counsel for the applicant has thus argued that the
applicant's land of Gata No. 267 has been acquired by respondent
authority for the project of Railway Board and in view of the
policy for providing the job which has also been notified, the
