Per: - Rajinder Singh Dogra, Judicial Member

1. The SWP/409/2018 was transferred from the Hon’ble High Court of

Jammu & Kashmir at Jammu and was registered as T.A/9084/2020 by

the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking

following relief: -

a) It is most humbly prayed that an appropriate writ, direction or

order may very kindly be passed commanding the respondents

to give retrospective effect to the appointment of the petitioner

as Constable in Executive Police from the date other selectees

of the same selection were appointed and given effect. Further

commanding the respondents to grant all the consequential

service benefits including seniority w.e.f 5/5/2008 and further

promotion if any having been given to all other selectees of the

same selection, including the monetary benefits.

b) Any other writ, direction or order which this Hon’ble Court

deems fit, may also be kindly granted in favour of the petitioner.

3. The facts of the case as pleaded by the petitioner in his pleadings are

as follows: -

a) The applicant is a citizen of India and a permanent resident of

the erstwhile State of Jammu and Kashmir. Being duly

qualified and eligible, he participated in a special recruitment

drive initiated by the respondents for induction of local youth as

Constables in the Executive Police, particularly in hilly and

terrorism-affected areas of District Kathua.

b) The said recruitment was conducted on the spot on 05.05.2008

at Lohai Malhar, District Kathua, by a duly constituted

selection committee comprising senior civil and police

including the Divisional Commissioner, Jammu, Inspector

General of Police, Jammu, Deputy Commissioner, Kathua and

Senior Superintendent of Police, Kathua. The applicant

participated in the selection process and, upon assessment of his

physical standards, eligibility and suitability, was declared

selected as Constable in the Executive Police.

c) Consequent upon his selection, the applicant, along with other

selected candidates, was directed to report to the office of the
