ORDER

Per: - Rajinder Singh Dogra, Judicial Member

1. The SWP No.2392/2019 was transferred from the Hon’ble High Court

of Jammu & Kashmir at Jammu and was registered as T.A

No.585/2020 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking

following relief: -

a) Writ of certiorari seeking quashment of Government Order

No.422-PW (Hyd.) of 2018, dated 26-12-2018 passed by

Respondent No.2 being illegal, arbitrary and violative of

Article 14 of the Constitution of India.

Declaration that the Petitioner is similarly situated to that of

the petitioners in SWP No.1328/2004, SWP: No.2047/2003 and

others who have been granted revised pay scale of Rs. 5150-

8300 at the entry level.

c) Writ of certiorari seeking quashment of Rule 9 (1) of the

Civil Services (Revised Pay) Rules, 1992 to the extent, it

provides that draftsmen shall be placed in the pay scale of

Rs.1200-30-1560-EB-40-2040 at the entry level, being in

conflict with a) the judgment passed by this Hon’ble Court in

SWP No.2047/2003 titled Sham Paul Randhawa & Ors. v. State

& Ors. read with judgment passed in LPA SW No.146/2009

titled State of J&K & ors. V/s Sham Paul Randhawa & Ors.
