reliefs:

a. Quash and set aside the impugned communication/order

dated 08.12.2025, issued by the Office of the Chief

Medical Officer, Baramulla, whereby the case of the

applicant for deputation to Six Months LHV Training

Course has been illegally withheld/kept pending.

b. Declare that the applicant is and has always been a

member of District Cadre Baramulla, having been

continuously posted, shown in seniority lists, and

considered for deputation and training by the

respondents, and that the respondents are estopped from

disputing her cadre/lien status at this belated stage.

c. Issue a writ/order/direction commanding the

respondents to forthwith depute the applicant for Six

Months LHV Training Course at School of Nursing,

Baramulla, strictly in accordance with her seniority and

eligibility, either in the ongoing batch or the immediately

next available batch.

d. Direct the respondents to treat the applicant as having

undergone LHV Training notionally, in case deputation is

delayed due to pendency of litigation, and to extend all

consequential service and promotional benefits from the

date her immediate junior was deputed.

e. Declare the action of the respondents as arbitrary,

discriminatory and violative of Articles 14 and 16 of the

Constitution of India, being based on extraneous

considerations and unsupported by any statutory rule.

f. Direct the respondents to accord parity to the applicant

with similarly situated employees, particularly those who

were relieved/transferred along with the applicant and

who have been granted promotions and training benefits,

including but not limited to Khata Bano.

g. Issue a direction restraining the respondents from

deputing any official junior to the applicant for LHV

Training Course or granting promotional benefits during

the pendency, of the present OA, in violation of seniority

norms.

h. Direct the respondents to consider and decide the
