ORDER

Per: - Rajinder Singh Dogra, Judicial Member

1. The applicant has filed the present Original Application under Section

19 of the Administrative Tribunals Act, 1985 seeking the following reliefs: -

i) Setting aside Order No.84-SSB of 2020 dated 28-02-2020 issued by respondent No.2 to the extent the selection of the applicant as Teacher pursuant to Advertisement Notice No.07 of 2010 has been cancelled abinitio after rendering more than 07 years service as Teacher that too at the back of the applicant without offering him opportunity of being heard in the matter.

ii) Setting aside Order No.CEO/D/Legal/2020/1632-36 dated 23-10-2020 whereby the appointment of the applicant as Teacher District Cadre Doda made pursuant to order No.CEO/D/Estt/4492-96 dated 13-05-2013 has been cancelled abinitio by respondent No.4 without affording opportunity of HARSHIT H C A =I R N S , H O I = T C Y e A n D tra A l V Administrative Tribunal Jammu Bench, OU=Court master, PostalCode=

being heard to the applicant in violation of principles of natural justice.

iii) Directing the respondents to allow the applicant to perform duties as Teacher in District Cadre Doda pursuant to his selection and appointment made by virtue of order No.CEO/D/Estt/4492-96 dated 13-05-2013 as the applicant has been selected in a fair and transparent selection process initiated by respondent No.2 by virtue of Advertisement Notice No.07 of 2010 and has rendered more than 07 years service as Teacher and has now became over-aged to apply for any service in any Govt. Department.

Prayer for the grant of any other interim or final relief as may be deemed appropriate in the facts and circumstances of the case in favour of the applicant.

2. The facts of the case as averred by the applicant in his pleadings, are as follows: -

a) The applicant, a permanent resident and domicile of the Union Territory of Jammu and Kashmir, approached this Tribunal aggrieved by the cancellation of his selection and appointment to the post of Teacher, District Cadre Doda, after he had already rendered more than seven years of continuous service. The grievance arises out of Order No. 84-SSB of 2020 dated 28.02.2020 issued by the Jammu and Kashmir Services Selection Board, whereby the recommendation of the applicant was cancelled ab initio, followed by Order No. CEO/D/Legal/2020/1632-36 d
