1. The applicant has filed the present Original Application under Section

19 of the Administrative Tribunals Act, 1985 seeking the following reliefs: -

a) Directing the respondents to release and pay the G.P Fund amount of Rs. 3,81,232/- with interest @ 9% from 07.09.2021 to the applicant.

b) Direction to the respondents to process the case of family pension so that the pension is sanctioned in favour of the applicant being the widow of the deceased and pay all other retiral benefits to the applicant.

2. The facts of the case as averred by the applicant in her pleadings, are as follows: -

a) The applicant, Smt. Shabnam Begum, is the widow of Late Shri Mohd. Shafi, who was initially engaged as a Rehbar-e- Taleem (RET) teacher vide order dated 09.09.2003 and was posted at UPS Tipri Zenhari, Zone Thathri, District Doda. After rendering more than five years of continuous and satisfactory service, the deceased employee was regularised as a General Line Teacher vide order dated 30.03.2009, with effect from 19.09.2008, and was adjusted against an available vacant post in Primary School Tipri Zenhari. He continued to discharge his duties as a regular teacher and was paid salary and other service benefits without interruption till the date of his death.

b) Unfortunately, while still in service, the deceased employee expired on 07.07.2021, leaving behind the applicant (his widow), one major son, and two married daughters. A legal heir certificate dated 23.08.2021 was issued by the competent authority, wherein the applicant was reflected as the widow of HARSHIT HARSHIT YADAV C=IN, O=Central Administrative Tribunal Jammu Bench, OU=Court master, PostalCode=180001, L=jammu, S=JAMMU AND KASHMIR, STREET="

the deceased. The service records of the deceased also show the applicant as the nominee for receiving retiral and post-death benefits.

c) After the demise of her husband, the applicant approached the respondent authorities for release of the General Provident Fund (GPF), family pension, and other admissible retiral benefits. Upon verification of records, the competent authority calculated the GPF accumulation of
