ORDER

Per: - Rajinder Singh Dogra, Judicial Member

1. The applicant has filed the present Original Application under Section

19 of the Administrative Tribunals Act, 1985 seeking the following reliefs: -

i) To issue appropriate writ, directions order, directing in the nature of Writ of Mandamus directing the respondents to grant the applicant one annual increment for the period of Ist January 2023 to 31st December 2023 payable on 01st January, 2024 i.e. on the next day of his superannuation, in accordance with J&K Civil Service (Revised) Pay Rules, 2018.

ii) To issue appropriate writ, directions order, directing the respondents to recompute the applicant's retirement benefits, including pension, gratuity, and leave encashment, taking into account the granted increment.

iii) To issue appropriate writ, directions order, and direct the respondent to the revised pension payment order.

iv) To issue appropriate writ, directions order, directing the respondent to pay arrears of pension with 6% per annum simple interest for the for the delay period.

v) Any other order or direction which this Hon'ble Tribunal may deem fit in the circumstances of the case may also be passed in favor of the applicant and against the respondents in the interest of justice and equity.

2. The facts of the case as averred by the applicant in his pleadings, are as follows: -

a) The applicant, Anil Kumar Dubey, was initially appointed in the School Education Department of the then State of Jammu and Kashmir on 09.03.1987.
