ORDER

1. The SWP/WPC/1334/2018 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.670/2021 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

a) Allow this writ petition of the petitioner.

b) Issue Writ in the nature of Mandamus commanding the respondent authorities to conclude and finalize the selection process for the post of Prosecutor, Divisional Cadre Jammu, advertised vide Advertisement Notice item No. 201 (03 of 2016) dated 30-06-2016 whereby the petitioner herein has been provisionally selected in the department of Consumers Affairs & Public Distribution.

dated 30-06-2016.

d) the Issue writ of Mandamus commanding respondents to confer the notional benefits to the petitioner.

e) Pass such other appropriate order as facts of the case demand and this Hon'ble Court may deem just and proper in favour of the petitioner.

3. The facts of the case as pleaded by the petitioner in her pleadings are as follows: -

a) The present Transfer Application has its genesis in SWP No.

1334/2018, originally instituted before the Hon’ble High Court of Jammu & Kashmir at Jammu and subsequently transferred to this Tribunal and registered as T.A. No. 670/2021. The applicant, Smt. Parul Bhalla, a permanent resident of the erstwhile State of Jammu and Kashmir, invoked the writ jurisdiction aggrieved by the prolonged inaction and failure of HARSHIT H C A =I R N S , H O I = T C Y e A n D tra A l V Administrative Tribunal Jammu Bench, OU=

b) The Jammu and Kashmir Services Selection Board (respondent No.2) issued Advertisement Notification No. 03 of 2016 dated 30.06.2016, whereby, inter alia, one post of Prosecutor under Item No. 201 was advertised for the Department of Consumers Affairs and Public Distribution. The prescribed eligibility for the said post was graduation in law along with three years’ experience at the Bar. The applicant, being fully eligible and meeting all prescribed qualifications, submitted her application within time.
