ORDER (ORAL)

With the consent of the learned counsel for the parties the matter is taken up for final hearing itself.
2. By way of the present O.A. the applicant seeks following reliefs:-
“8.1 To quash and set-aside the order of debarment /cancellation dated 20.12.2022 as well as the SCN dated 19.09.2022 and to further direct the respondent that final result of the applicant be declared and further the applicant be given appointment to the post as per merit obtained in present selection process of CHSL- 2019 with all consequential benefits including seniority & promotion and pay & allowances.
8.2 To quash and set-aside final result of dated 10.05.2022 in respect of applicant herein whereby the result of applicant (within 104 candidates) have been kept withheld on the ground of "for further scrutiny by the Commission regarding suspected use of unfair means" in selection process i.e. CHSL -2019.
8.3 To direct the respondent to give the benefit of judgment dated 14.02.2025 in OA No-2953/2022 (titled Himanshi & ors. Vs. UOI).
Or/and Any other relief which this Hon'ble court deems fit and proper may also be awarded to the applicant.”
3. It is not in dispute by the either side that the present matter is identical to O.A. No. 2953/2022 (Batch)
SHILPI GUPTA Himanshi Vs. Union of India & Ors., which has already
been adjudicated by a co-ordinate Bench of this Tribunal
on 14.02.2025. The ratio of the said decision is
reproduced herein below:-
“29. Given the above discussion we are of the opinion that the impugned orders needed to be set since they are arbitrary and based on flimsy grounds, casting a serious stigma on the applicant’s career by proposing a seven-year debarment from SSC examinations. Such a severe penalty could only be imposed if there was a clear-cut and conclusive finding of guilt based on legally tenable grounds. In the present case, no such grounds existed, making the imposition of this punishment entirely arbitrary and jeopardizing the applicant’s career.
30. In view of the above, the impugned orders dated 10th May 2022 (concerning to the applicants), 13th September 2022 and 21st October 2022 are hereby quashed and set aside. The respondents are further directed to consider the candidature of the applicant in accordance with the merit secured by the applicants in the CHSL 2019 examination, granting all consequential benefits as per law within a period of four months from the date of receipt of a certified copy of this order.”
4. Learned counsel for the applicant states that the examination in question in the present matter is same which has been already been dealt with in the matter of Himanshi.
5. It has been fairly conceded by the either side that the said matter has been taken in a Writ Petition No.
15273/2025 before the Hon’ble High Court of Delhi.
6. Learned counsel for the respondents draws attention to the order passed by the Hon’ble High Court on 06.10.2025 in W.P. No. 15273/2025, which reads as SHILPI GUPTA SHILPI GUPTA2026.02.10 under:-
